Welcome to The Super Patch Company Affiliate Program! Please read the following Terms and Conditions ("Agreement") carefully before applying to join the program. By applying to or participating in our Affiliate Program, you agree to comply with and be bound by the terms outlined below.
1. Eligibility
To participate in the Affiliate Program, you must:
· Be at least 18 years of age.
· Provide accurate and complete information during the application process.
· Operate a website, social media channel, or other platform that aligns with our brand values.
· Not engage in fraudulent, deceptive, or misleading marketing practices.
· We reserve the right to accept or reject any affiliate application at our sole discretion.
2. Referral Links
Upon acceptance into the program, you will receive access to unique referral links to share with your audience. You agree to:
· Only use your assigned referral links when promoting The Super Patch Company.
· Not modify or alter the links in any way that may interfere with tracking.
· Clearly disclose your affiliate relationship as required by the Federal Trade Commission (FTC) and other applicable regulations (e.g., including #ad or “I may earn commissions…” in your posts).
3. Commissions
Affiliates earn a commission on qualifying purchases made through their referral links. Commission details are as follows:
· Commission Rate: 25%
· Payment Threshold: Minimum payout of $40 required.
· Payment Frequency: Monthly, within 30 days of the end of each month.
· Eligible Transactions: Only transactions completed via your referral link and not cancelled or refunded within 30 days are eligible for commission.
· The Super Patch Company reserves the right to adjust commission structures at any time with notice to affiliates.
4. Prohibited Practices
Affiliates may not:
· Use their referral links for self-purchases.
· Use paid advertising (e.g., Google Ads, Facebook Ads) that includes our trademarked name or brand terms without prior written approval.
· Misrepresent the products, pricing, or availability.
· Send unsolicited messages ("spam") containing referral links.
· Promote on websites or content that contains hate speech, violence, illegal activity, or adult material.
· Violation of these terms may result in termination from the program and forfeiture of unpaid commissions.
5. Intellectual Property
Affiliates may use approved marketing assets, logos, and content provided by The Super Patch Company solely for the purpose of promoting our products. You may not modify or claim ownership of any such materials.
6. Termination
Either party may terminate this Agreement at any time for any reason with immediate effect. Upon termination:
· All pending unpaid commissions will be evaluated and paid out if earned legitimately and in compliance with the Terms & Conditions.
· You must cease use of all referral links and branded materials.
7. Limitation of Liability
The Super Patch Company will not be liable for indirect, incidental, or consequential damages (including loss of revenue or profits) arising in connection with this agreement or the affiliate program.
If the Affiliate makes comments, posts or any form of communication on any platform (including but not limited to social media / online channels) while the content of such comments, posts or communication is not within the approved guidelines from The Super Patch Company, the Affiliate is responsible for the direct, or indirect or consequential damages arising due to such unapproved action.
8. Relationship of Parties
You agree that you are acting as an independent contractor and not as an employee or agent of The Super Patch Company. You do not have the authority to make or accept offers or representations on our behalf.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Florida, USA.. Any disputes shall be resolved in the courts of the state of Florida.
10. Changes to Terms
We reserve the right to modify these Terms & Conditions at any time. Continued participation in the program after changes are posted constitutes your acceptance of those changes.
11. Data Privacy
Our privacy policy is stated on our website where you visit to place orders. The Super Patch Company and the Affiliates will follow this privacy policy.
11. Other Policies and Processes
The Super Patch Company will make accessible the Return Policy, process/eligibility around any promotions or contests on the website accessible to Affiliates. You agree to comply with such states’ Policies and Processes.
